Terms & Conditions


§1 Scope

  1. The business relationship between blinkyparts.com (Timo Schindler hereafter referred to as the “seller”) and the customer (hereafter referred to as the “customer” or “buyer”) is subject exclusively to the following General Terms and Conditions in the version that was valid at the time of purchase.

  2. Deviating terms and conditions of the customer shall not apply unless the seller expressly agrees to their validity.

  3. The General Terms and Conditions (GTC) apply to both consumers and businesses unless a differentiation is made in the respective clause.

Conclusion of Contract, Right of Withdrawal

  1. Once the offer to purchase is completed the buyer submits it to the seller. When submitting an offer, the text of the contract is transmitted to the buyer in text form (via e-mail) after the order has been sent. The order is then processed. If the payment method “prepayment” is selected, the buyer will be informed of the bank details in the order confirmation.´

  2. he ordered goods will be delivered by the seller after receipt of payment.

  3. f the ordered product is not available, the seller will suggest the delivery of a comparable product. If the buyer does not wish to receive a comparable product, the seller will immediately reimburse any payments already made by the buyer.

  4. All prices are in Euros and include the statutory VAT.

§3 Delivery

  1. The delivery of goods shall be made by dispatch to the delivery address provided by the buyer.

  2. Information about the shipping costs can be found in the table for shipping and payment (see “Shipping and Payment” in the footer). The shipping will be carried out by Deutsche Post, DHL or DPD.

  3. For deliveries abroad, the customer is responsible for customs duties and taxes. For deliveries abroad, there is usually a higher flat-rate shipping fee. Depending on the country, this is displayed during the ordering process.

  4. If the delivery address is not correctly specified by the buyer, the buyer shall be liable for any additional costs incurred.

  5. f the delivery is not collected by the buyer immediately after the respective shipping company has attempted to deliver the goods to him, the seller shall not be responsible for any resulting loss of quality.

  6. f the buyer does not collect the delivery or refuses to accept it, the seller has the right to withdraw from the contract. The buyer shall compensate the seller for the resulting damage.

§4 Offsetting, Retention

The buyer is only entitled to set-off if his counterclaims have been legally established or recognized by the seller.

§5 Payment Conditions, Default, Retention of Title

  1. The seller retains title to the purchased goods until all payments under the purchase contract have been received.

  2. The buyer must inform the seller immediately of any enforcement measures against the reserved goods and hand over all documents necessary for an intervention. The buyer must inform third parties of the existing rights prior to enforcement.

  3. Payment must be made using the payment methods valid on the websites at the time of the order.

  4. There is no possibility of a cash discount deduction.

  5. If the direct debit is not honored due to reasons for which the buyer is responsible, the seller is entitled to claim such direct debit note fees from the buyer.

§6 Warranty for Defects

In the event of a defect, the seller will be liable in accordance with the statutory provisions.

Exclusion of Liability

  1. The seller shall only be liable for contractual breaches of duty and unauthorised acts if he is guilty of gross negligence or intent. This shall not apply in the event of injury to life, limb or health of the buyer. In this respect, the seller shall be liable for any degree of fault.

  2. The aforementioned limitation of liability shall also apply to vicarious agents of the seller.

  3. Insofar as liability for damages is not excluded, such claims shall become statute-barred within one year of the statutory commencement of the limitation period.

§8 Supply of Tax-exempt Products

The tax reduction to zero results from section 12 para. 3 No. 1 UStG. According to this, the VAT for solar modules and their essential components and the storage system is reduced to 0% if the Buyer is the operator of a photovoltaic system and the photovoltaic system is either:

  1. is installed on or near private dwellings, flats or public and other buildings serving the public good, or

  2. the installed gross capacity of the photovoltaic system does not or will not exceed 30 kilowatts (peak) according to the Market Master Data Register (MaStR).

By submitting an order for a corresponding product, the buyer declares that he fulfils one or both conditions for tax concessions.

§9 Wertgutscheine

Wertgutscheine, die in unserem Shop erworben werden, sind ab dem Ende des Kaufjahres drei Jahre lang gültig. Nach Ablauf dieser Frist kann der Wertgutschein nicht mehr eingelöst werden. Eine Auszahlung des Gutscheinwertes in bar ist ausgeschlossen. Sollte der Wertgutschein nicht vollständig eingelöst werden, bleibt der Restbetrag innerhalb der Gültigkeitsdauer erhalten und kann für weitere Einkäufe verwendet werden. Nach Ablauf der Gültigkeitsdauer verfällt der verbleibende Wert.

§10 Final provisions

  1. If the buyer is an entrepreneur, German law shall apply exclusively.

  2. If the buyer is an entrepreneur, Regensburg is agreed as the place of jurisdiction.

  3. Note: We do not participate in a dispute settlement procedure before a consumer arbitration board.
